Frequently asked foreclosure questions:

I have been served with a foreclosure Summons and Complaint. What should I do?

Properly responding to a foreclosure Summons and Complaint is the most critical component to preserving your options once you’ve been served. Contact us today to evaluate your alternatives.

What if I do nothing?

After a period of 20 days following the service of the foreclosure Summons and Complaint, your bank may move for entry of a Default Judgment against you. Thereafter, a writ of possession may be issued directly your local sheriff to physically remove you from your home. Your house may be sold at public auction and you may be personally liable for the deficiency between the sale price of your home at auction and the amount you owe on the unpaid principal of your mortgage.

Can I keep my home?

Whether or not you will be able to keep your home depends on many factors, including your home’s current value, amount that you owe on your home, your income, your bank’s financial position, financial markets and time. Being proactive in addressing foreclosure is the most important factor that you can control.
